It was in 2017 when De Lima was arrested and detained at Camp Crame after the Department of Justice filed charges against her due to her alleged involvement in the illegal drug trade or alleged violation of Republic Act 9165 or Comprehensive Dangerous Drugs Act of 2002.

In the three drug cases filed against her, she was acquitted on Criminal Case 17-166, in which she was accused of allegedly extorting drug money from Peter Co, a convicted drug lord. The case was dismissed because according to the court, the evidence against De Lima was weak.

It can also be recalled that witnesses Kerwin Espinosa and Rafael Ragos retracted their previous statements against the former senator.

De Lima’s co-accused Ronnie Dayan also retracted the statements he had made against the former senator because, he said, he was only forced to testify against her.

In a video, Showbiz Fanaticz, a YouTube channel claimed that the former senator will have another 12 years in prison.

But according to De Lima’s lawyer Atty. Dino De Leon, the continued imprisonment or the release of the former senator does not depend on the result of the last election, but on the decision of the court in the pending cases against her.

“It is the strength and the merits of the case,” De Leon said in an interview with ABS-CBN Fact Check Team.

“Wala kaming nakikitang malakas na evidence against De Lima… but we leave it up to the discretion of the judge,” he added.

The video uploaded by Showbiz Fanaticz Channel on YouTube last June 17 was titled: “JUST IN: Matapos MATALO sa SENADO| LEILA DE LIMA muling MAKUKULONG ng 12 yrs.| “MABUBULOK KA NA DYAN.”

De Leon denied such fake news.

Currently, De Lima has filed two motions for bail for the remaining two cases against her. According to De Leon, if the court allows the two motions, De Lima can post bail for her release.
