National Heroes’ Day 2020 pay rules
The Department of Labor and Employment (DOLE) has released the pay rules in observance of the National Heroes’ Day, today, August 31, 2020, which has been declared by President Rodrigo Duterte via Proclamation No. 845 as a Regular Holiday.
According to the labor department, employees who will report on their duties today will get 200% of their regular pay, meaning double pay.
As per Labor Advisory (LA) No. 27 issued by DOLE, the employee who renders overtime work during a regular holiday will get another 30% of the worker’s hourly rate.
DOLE noted based on the article published by businessmirror.com.ph, that if the holiday falls on the rest day of the employee, he/she will get an additional 30% of its holiday pay.
The employee will get 100% of their regular pay during the National Heroes’ Day regular holiday if the worker files vacation leave effective on that day.
Labor and Employment Secretary Silvestre H. Bello III said that establishments may postpone or waive the holiday pay payment, including National Heroes’ Day, “until such time the present emergency situation has been abated and the normal operations of the establishment is in place” due to the COVID-19 pandemic.
He said, “Establishments that have totally closed or ceased operation during the community quarantine period are exempted from the payment of the holiday pay under this Advisory.”

Meanwhile, DOLE reported that as of August 24, 2020, 923 companies with16,282 workers have permanently stopped their operations starting January to August 23.
