ICC Prosecutor Calls Duterte’s Arrest a Significant Moment for Justice

KARIM AHMAD KHAN – The International Criminal Court (ICC) Prosecutor addressed the arrest of former Philippine President Rodrigo Duterte, calling it a significant moment for the alleged victims of his controversial “war on drugs.”

In a video statement, Khan explained that ICC pre-trial judges had found reasonable grounds to believe that Duterte committed the crime of murder. This allegation stems from his role as the founder and head of the Davao Death Squad, his tenure as mayor of Davao City, and later as the president of the Philippines.

Khan emphasized that Duterte’s arrest demonstrates the strength of the rule of law, reinforcing that accountability is possible. He acknowledged that while international law has its limitations, it is stronger than some may believe. He also reassured that Duterte remains presumed innocent until proven guilty in court. The prosecutor’s office will now focus on presenting its case before the ICC judges. He further highlighted the significance of this arrest for the victims, stating that it represents hope for justice and recognition of their suffering.

Meanwhile, the ICC Office of the Prosecutor formally welcomed Duterte’s arrest and transfer into ICC custody. They reiterated that their ongoing investigation into Duterte’s actions is based on independent and impartial findings. The office alleges that between November 1, 2011, and March 16, 2019, Duterte was responsible for crimes against humanity, specifically murder, as part of a widespread and systematic attack against civilians. The pre-trial chamber issued an arrest warrant on March 7, 2025, after determining that the case fell within the court’s jurisdiction since the alleged crimes occurred while the Philippines was still a State Party to the Rome Statute.

The ICC’s prosecution team, led by Deputy Prosecutor Mame Mandiaye Niang, worked closely with various agencies to secure Duterte’s arrest. They expressed gratitude to victims, witnesses, and human rights activists who cooperated in the investigation. The office also encouraged others with relevant information to come forward. Moving forward, preparations for Duterte’s initial court appearance and judicial proceedings are underway as the ICC continues to seek justice and accountability for victims of alleged human rights violations in the Philippines.
