Pay rules for the National Heroes Day, August 28, 2023
NATIONAL HEROES DAY – The Department of Labor and Employment (DOLE) reminded employers and private sector workers to follow payment rules for wages on August 28.
Based on Labor Advisory No. 17, Series of 2023, signed by Secretary Bienvenido Laguesma, workers should be paid correctly for the said holiday.
If employees worked on the regular holiday on August 28th, they should receive double their usual wage for the first eight hours. If they worked extra hours (overtime), they should get an additional 30% of their hourly wage. This calculation is based on their normal hourly wage multiplied by 200% (double) and then multiplied by 130% (including the overtime) for the number of hours they worked.
The advisory also says that if an employee worked on the regular holiday and it was also their usual day off, they should receive 30% more than their double basic wage. And if they worked overtime, they should receive an extra 30% of their hourly wage.
If employees didn’t work on that day, they should be paid their full wage for that day. However, this is only the case if they either worked or were on approved paid leave on the day just before the regular holiday.
Additionally, if the day just before the regular holiday is already a day off or a rest day for the employees, they should still get holiday pay if they worked or were on approved paid leave on the day before that day off or rest day.
This labor advisory was released following Proclamation No. 42, Series of 2022, and Proclamation No. 90, Series of 2022, which determine the official regular and special (non-working) days for the year 2023.
