Statement of Malacañang on SC Declaring Articles of Impeachment against Duterte “Unconstitutional”
Malacañang called on the Filipinos to respect the Supreme Court following its ruling on the Articles of Impeachment versus Vice President Sara Duterte.
In 2024, four (4) impeachment complaints were filed against Vice Pres. Sara Duterte in the House of Representatives. The fourth complaint signed by more than 2/3 of the members of the chamber was transmitted to the Senate and sparked speculations of a looming trial.

However, the Senate impeachment court returned Duterte’s impeachment to the House which Senate Pres. Chiz Escudero clarified as not a dismissal of the case. The Court sought for clarifications on the constitutionality of the impeachment complaint as well as a reconfirmation from the 20th Congress.

Eighteen (18) senator judges voted in favor of the return of the Articles of Impeachment against Vice Pres. Sara Duterte to the House of Representatives. Only five (5) senator judges were against the motion. The remand of Duterte’s impeachment took place before the 19th Congress has adjourned.

Amid the belief of Duterte’s camp that the Marcos administration allegedly wants to remove the Vice President from office, Malacañang emphasized multiple times that Pres. Bongbong Marcos will not intervene in the process.
Previously, Sen. Joel Villanueva claimed that some senators have agreed to start the impeachment trial against Duterte on August 4. Amid the calls for him to inhibit from the trial, Senate Pres. Chiz Escudero declined. He also stressed that the Senate will not rush the trial.

Recently, the Supreme Court released its decision ruling that the Articles of Impeachment against Vice Pres. Sara Duterte is “unconstitutional”. The high court said the Articles of Impeachment against the Vice President is “barred by the one-year rule”.
The decision of the Supreme Court over the Articles of Impeachment against Vice Pres. Sara Duterte has reached Malacañang. Based on a post of Inquirer, Palace press officer undersecretary Claire Castro called on the Filipinos to respect and trust the court and the institutions.
“We have yet to review the full text of the Supreme Court’s decision. We call on everyone to respect the Supreme Court and place their trust in our institutions,” she said.
The Malacañang press official also expressed that the impeachment process is handled by the judiciary and legislative branches of the government. Based on the post, she stressed that the Palace recognizes the independence of the two branches in carrying out their mandates.
