The issue between Vic Sotto and Darryl Yap centers on a legal dispute regarding Yap’s upcoming film, The Rapists of Pepsi Paloma, which allegedly harms Sotto’s reputation. Yap’s team, led by Atty. Raymond Fortun, has asked the Muntinlupa City Regional Trial Court to issue a gag order against Sotto. This order would prevent Sotto and his team from publicly sharing information about the case, including Yap’s response to the film.

Sotto filed a complaint against Yap for 19 counts of cyber libel, seeking PHP 35 million in damages. The complaint was triggered by the teaser for Yap’s film, released on January 1, which went viral because it linked Sotto to the late Pepsi Paloma. Sotto’s lawyer, Enrique dela Cruz, argues that the statements in the teaser are harmful and false.

Yap’s team argues that any public discussion about the case would violate Yap’s freedom of speech and harm the film’s creative value. They believe the gag order is necessary to prevent public comments on the case, as it could influence the court’s decision.

The court has not yet decided whether Yap’s trailer should be removed, and a decision will be made after a hearing on January 15. The two legal teams disagree on whether the court’s order requires the trailer to be taken down. Sotto’s team believes it does, while Yap’s team insists no final decision has been made.
