ABS-CBN In ‘Legal Limbo’ If Operates With Expired Franchise, Says Solon

ABS-CBN might be in “legal limbo” if the company continued to operate with an expired franchise, according to a lawyer.

A lawmaker on Wednesday said that ABS-CBN might be in “legal limbo” if the company continued to operate after its broadcast franchise expires in May.

This, as Albay 1st District Rep. Edcel Lagman encouraged his colleagues to discuss several bills seeking the license of ABS-CBN Corporation.

He noted that under the law, “no person shall commence or conduct the business of being a public telecommunications entity without first obtaining a franchise,” adding in his statement that persuading ABS-CBN to continue its operation with an expired franchise was “pushing it to a legal limbo fraught with possible lawsuits”.

Lagman also said that the issue “can be deliberated and approved within the next 6 session days before the Congress adjourns from March 14 to May 3 for the Lenten break.” The issue with ABS-CBN Corp’s franchise came after Solicitor General Jose Calida filed a quo warranto petition against the company, seeking to nullify ABS-CBN Corp’s franchise due to alleged abuses.
