According to Agence France-Presse, Natalia Harrell, 24, has been in jail for seven months in connection with the murder charge she is facing. Harell allegedly shot and killed a woman in Miami last July. She was six months pregnant when she was arrested.

Harrell’s camp argued in a petition filed last week that she was carrying a gun and feared for her life and the baby in her womb. According to reports, Harrell is not receiving proper medical care in jail.

Based on the petition, “the fetus has not committed any crime,” but it is imprisoned in “deplorable conditions,” and if the petition is denied, the baby will be born “on the concrete floor of the prison cell.”

Atty. William Norris told AFP that the father of the unborn child approached him to file a petition “on behalf of the fetus. “The child didn’t have a seat at the table when the decision to incarcerate the mother was made,” Norris said. It is stated in the petition that “the unborn child is a person.”

Meanwhile, women who are incarcerated usually have prenatal risk factors. Prior to being imprisoned, female offenders frequently neglected their own health in the community. Women who are incarcerated are more likely than the general population to deliver prematurely and have babies that are underweight.
