Complainants against VP Sara Duterte Ask Supreme Court To Reconsider Decision

SARA DUTERTE – Some of the complainants in the impeachment case against the Vice President filed a motion for reconsideration of the Supreme Court ruling.

The Supreme Court declared the articles of impeachment against Duterte “unconstitutional”. According to the high court, the impeachment complaint against the Vice President did not follow the one-year rule in the Constitution.

Furthermore, the Court also found that Vice Pres. Duterte was denied of her rights to due process. Four (4) impeachment complaints were filed against her in 2024 and the last one was the one transmitted to the Senate. Despite the ruling, the SC maintained that its decision does not dismisses the impeachment complaint against the Vice President.

The ruling of the Supreme Court on the impeachment complaint against Vice Pres. Sara Duterte is immediately executory but a motion for reconsideration may be filed. The House of Representatives previously expressed a plan to file a motion for reconsideration over the decision of the High Court.

House Speaker Martin Romualdez also stressed the “exclusive” duty of the chamber to initiate an impeachment and called on the members not to bow in silence over the SC ruling despite recognizing it.

“Let me say this with the utmost respect: The Supreme Court has spoken, and we recognize its decision. But let it never be said that the House of the People bowed in silence,” the House Speaker said.

Speaker Martin Romualdez said the Supreme Court “may close a case, but it cannot close a cause. The pursuit of accountability is not a moment—it is a mandate”. Recently, some complainants behind the impeachment case against Vice Pres. Sara Duterte filed a motion for reconsideration of the Supreme Court ruling.

Based on a report on PhilStar, members of civil society coalition Tindig Pilipinas filed the motion for reconsideration over the Supreme Court ruling in the impeachment case against Vice Pres. Sara Duterte. The group is led by its convenors Sylvia Claudio and Teresita Deles.

According to Sylvia Claudio, aside from hoping for the reversal of the ruling of the Supreme Court, they also aim to get a “legal status” for participation along with other parties in challenging the legality of the decision of the high court. According to her, they “severely disagree” with the ruling of the Supreme Court.

Furthermore, based on the report, the group also urges the Senate to push through with the impeachment trial of Vice Pres. Sara Duterte. Based on the report, Claudio stressed that their request is “forthwith”. They also believe that the SC allegedly overstepped the Senate in the process.

“The Senate has already started with the impeachment proceedings and the Constitution is clear that it is the Senate which has mandate to hold impeachment trial,” she said.

Currently, there is a resolution circulating in the Senate seeking for the impeachment trial of Vice Pres. Sara Duterte to proceed. However, on the other side, Senate President Pro Tempore Jinggoy Estrada claimed that most senators are likely to abide by the Supreme Court ruling.
