Counter Affidavit of Ogie Diaz vs. Bea Alonzo’s Cyber Libel Case
OGIE DIAZ – The talent manager-vlogger has filed a counter affidavit in response to the cyber libel case filed against him by Bea Alonzo.
In a press statement, Ogie’s lawyer, Regie Tongol, revealed that Ogie also filed a perjury counter-charge with damages against Alonzo at the Regional Trial Court in Quezon City this Tuesday.
In their seventy-page counter affidavit, Ogie Diaz’s lawyer, Regie Tongol, criticized Bea Alonzo’s sixteen-page complaint for not specifying the individuals who made the defamatory statements, implying that all the statements were attributed to Diaz.
“In our seventy-page (70) Counter-Affidavit, we called out the Complainant by not clearly stating in her sixteen-page (16) Complaint-Affidavit the specific individuals who uttered the specific defamatory statements making it appear it was all Mr. Diaz who made them,” said Tongol.
Tongol added that Bea Alonzo’s complaint lacked clear and convincing proof of ‘actual malice,’ such as ‘reckless disregard for the truth’ or ill-motive, which is required legally if the complainant is a public figure.
“They even failed to show clear and convincing proof of ‘actual malice’ whether in the form of ‘reckless disregard for the truth’ or ill-motive which is a legal requirement and standard if the Complainant is a public figure,” Tongol added.
It can be recalled that in May of 2024, Bea filed three separate cyber libel complaints at the Quezon City Prosecutor’s Office against Ogie and Cristy Fermin. The complaints also included their respective co-hosts on their online programs.
Ogie responded to Bea’s complaint, saying he will face it in due time. “Tulad ng lagi naming hinihirit sa ‘Ogie Diaz Showbiz Update,’ sila pa rin ang gusto naming magkatuluyan sa ending,” Ogie said, referring to Bea and her former fiancé, Dominic Roque.
