The entrance to becoming parents or parents again comes along with excitement, joy, and added responsibilities on both the father and the mother. In the Philippines, working females who are pregnant, has just given birth or lost a baby, or about to deliver a baby may avail the Maternity Leave from work.
The Maternity Leave is a paid leave. It was designed to give the mothers time to take care of the newborn baby and feed him/her after childbirth or to deal with a painful loss in some cases. The said leave can be stretched to up to 105 days. In the case of the fathers, they may also qualify to the Paternity Leave.
The Paternity Leave was designed to give fathers some time to take care of their wives and newborn baby. However, there is a huge difference between it and the Maternity Leave as fathers are only allowed paid leaves of up to seven (7) days.
Who are qualified to avail this type of leave? It is important that a male worker meets the Paternity Leave requirements set under this type of privilege offer which include the following qualifications:
- married man who is living with his wife
- locally-employed at the time of childbirth or wife’s delivery regardless of the employment status
- regular
- casual
- probationary
- seasonal
- fixed-term
- notify the employer regarding the pregnancy and the expected delivery date of the wife
- valid from the first to the third pregnancy of the wife
- legally married to and living with wife who is pregnant, has given birth, or had a miscarriage
Based on the Paternity Leave requirements set above, fathers or fathers-to-be who are not married to their partners and those who are not living with their spouses may not be eligible to avail the Paternity Leave.
In case the couple wants an extended leave for the father, the wife can transfer some her leave credits under 105-Day Expanded Maternity Leave Law to him whether or not they are legally married.
There is only one (1) documentary requirement in applying for the Paternity Leave offer and that is the Paternity Notification Form from your employer.
