DOLE Releases Pay Rules for December Holidays
The Department of Labor and Employment (DOLE) reminded the employers of pay rules for December 2020 holidays.
Labor Secretary Silvestre Bello III has issued the pay guidelines for private sector employees during the holidays declared this month of December 2020. Employers must observe the payment guideline.
DOLE released Labor Advisory No. 32, series of 2020 declaring December 8 (Feast of the Immaculate Conception of Mary) as special non-working holiday while December 25 (Christmas Day) and 30 (Rizal Day) as Regular holidays.
The agency also gives prescribed guidelines for proper payment on December 8, 24 and 31, 2020:
- No Work, No Pay
- Workers who will report to work are entitled to receive additional 30 percent of their basic wage for the first eight hours
- Overtime workers must receive an additional 30 percent of their hourly rate
- If worker’s rest day fall on special holiday, he/she must get an additional 50 percent of their basic wage
- Overtime work is entitled for an additional 30 percent of the employee’s hourly rate during that day
Pay Rules for Regular Holidays
- Basic wage + COLA x 200 percent
- Hourly rate of the basic wage x 200 percent x 130 percent x number of hours worked
- Basic wage + COLA x 20- percent + 30% (Basic wage x 200%)
- Hourly rate of the basic daily wage x 200 percent x 130 percent x 130 percent x number of hours worked
