Alice Guo Faced w/ Comelec Material Misrepresentation Case
COMELEC – The Commission on Elections is set to release its decision on the misrepresentation case versus Alice Guo before October 30.
Countless people reacted to the announcement of the lawyer of Alice Guo that the former mayor is running for re-election as Bamban mayor in the 2025 Midterm Election. According to Attorney Stephen David, it is up to the people of Bamban if they still want her as mayor or not.
David also stressed that not even the petition for the cancellation of Guo’s Birth Certificate or the ruling of the Ombudsman may stop her candidacy. According to the lawyer, the cancellation of the former Mayor’s Birth Certificate will take a long process. He stressed that there is still no decision declaring her as not a Filipino.
The lawyer of Alice Guo also stressed that the decision of the Ombudsman is not final. Even Solicitor General Menardo Guevarra said that there are no verdict yet on the charges against the former Mayor thus, she can file her candidacy.
Atty. Stephen David expressed that only the Commission on Elections or the Comelec can decide on the candidacy of the former Mayor if she decides to file her CoC. Recently, the poll body spoke on the material misrepresentation case against Guo.
Based on a report on ABS-CBN News, Comelec chairman George Erwin Garcia said that they will release the final decision on the material misrepresentation case versus Alice Guo before October 30. Furthermore, Garcia also confirmed that they have received the decision of the Office of the Ombudsman to perpetually disqualify the former Bamban Mayor from holding public office.
“Basta bago matapos ang October 30 the Comelec will have a recommendation. Hindi lang sa kanya (Guo), kundi sa napakadaming natanggap kami na decision ng Ombudsman,” the Comelec Chairman said.
Based on the report, the poll body’s Chairman said their decision will not be dependent on the ruling of the other courts or the findings of some government agencies. According to Garcia, a candidate for the election can be removed from position if one has been declared as a nuisance candidate; facing a complaint of misrepresentation, or ordered by the Ombudsman to be perpetually disqualified from holding public office.
Comelec chairman George Garcia stressed that the third ground is the most crucial. According to him, the Commission will recognize the decision of the Office of the Ombudsman.
“Kahit pa ito ay nakaapela sa mas mataas na hukuman, the Comelec can always implement and execute a decision of the Office of the Ombudsman,” he said.
